EU Single-Use Plastics Directive
Increase in littering costs in Austria
From 2023, the reporting of single-use plastic products and packaging (Single Use Plastics (SUP)) is mandatory in accordance with the Single Use Plastics Directive (SUPD).
These products must be reported to the collection and recovery systems (Producer Responsibility Organisations (PRO)) once a year by 15 March of the following year at the latest. From the reporting of single-use plastics for the year 2023, the collection and recycling systems must pay standardised SUP surcharges nationwide in accordance with the Packaging Ordinance.
This so-called littering levy is intended by the legislator to compensate for the cleaning and sanitisation activities caused by the products and packaging concerned.
To which products does the EU Single-Use Plastics Directive apply?
If your company places products in the following categories on the market, you are affected by the obligation under section 21a(1) of the Packaging Ordinance 2014:
- Beverage cups
- Rigid or flexible food packaging
- Beverage containers (PET beverage bottles, other beverage bottles, other beverage containers such as Tetrapak)
- Humidifying wipes
- Balloons
- Fishing gear
- Tobacco products (filter weight)

What costs are incurred
As a collection and recycling system, we are obliged to levy the following surcharges in accordance with Section 9 (2a) VerpackVO
Please note that these surcharges are not contributions from Reclay Systems. Although these SUP surcharges must be collected by all collection and recycling systems in Austria, they must be passed on to the municipal contractual partners (municipal associations, municipalities, cities). The Verpackungskoordinierungsstelle gemeinnützige GmbH (VKS) checks the accuracy and completeness of the reported quantities.
