Reclay Systems, a producer responsibility organisation, provides its clients with the collective fulfilment of their obligations under the Waste Act. By setting up and operating a system of collective management of packaging and non-packaging waste in contracted municipalities, it fulfils the obligations of collection, transport, recovery, recycling of packaging and non-packaging waste placed on the market in the Slovak Republic for producers.

  • management of packaging and non-packaging waste in accordance with Annex 3a of the Waste Act,
  • registration of producers in the registers of producers of packaging and non-packaging products at the Ministry of the Environment of the SR,
  • keeping records for individual represented producers, reporting summary registration data of producers to the Ministry of the Environment of the SR,
  • fulfilling information obligations in relation to end users of packaging/non-packaging products
  • notification of compliance with mandatory recovery and recycling limits

Who is the producer?

According to Act No. 79/2015 Coll. on Waste, more precisely according to § 52 point (11), a producer of packaging is a natural or legal person who:

A

Uses packaging to package goods or fill goods into packaging and markets those goods under its own brand name.

B

Is a person for whom the goods are packaged or filled and under whose brand name the goods are marketed.

C

Places goods on the market in packaging in a manner other than pursuant to points (a) and (b) or transports or has transported across the state border of the Slovak Republic goods in packaging and places them on the market or for distribution in the Slovak Republic.

D

As a distributor, it carries out the transfer of packaging to the end user for immediate packaging of the goods, for a fee or free of charge.

E

As a distributor, the distributor uses packaging to wrap the distributed goods or a part thereof or to fill with the distributed goods; or

F

Places packaging on the market except to a person who supplies unused empty packaging to a person referred to in point (a), (b), (c), (d) or (e) or to a person who packages or fills goods for a person referred to in point (b).

Mind the waste paradox!

In most cases, persons who do not produce any packaging are considered to be packaging producers. At the same time, actual producers of empty packaging are not packaging producers within the meaning of the Waste Act.

What is a non-packaged product?

An unpackaged product is a product that:

 

  • is neither packaging nor intended for packaging,
  • the waste from the product forms part of municipal waste,
  • may be made of the following materials: glass, paper and cardboard and plastic.

Obligations of packaging and non-packaging producers

  • Register in the Register of producers of the reserved product and notify changes to the registered data,
  • ensure the material composition of the product, its construction and its labelling in accordance with the Waste Act,
  • fulfil the information obligation towards the public and the waste processor, ensure that the recovery and recycling targets for packaging waste are met,
  • ensure the management of the waste stream to the extent and in the manner specified in the Waste Act,
  • ensure the recovery and recycling of the packaging and non-packaging waste stream at least at the level of the mandatory recovery and recycling targets and limits for that waste stream,
  • keep and maintain records and report data therefrom to the Ministry to the extent prescribed and retain the reported data,
  • fulfil the information obligation in relation to the end users of the product
  • calculate its collection rate and market share
  • ensure that the entire quantity of separately collected municipal waste belonging to the waste stream is removed from the municipality in which it is responsible for the packaging and non-packaging waste stream and ensure the ongoing financing of the management of the waste stream so removed,
  • appoint an authorised representative in the case of a foreign producer.
