Reclay Systems is an authorized Producer Responsibility Organization (PRO) that ensures collective fulfillment of legal obligations under the Waste Act on behalf of its clients.
Our mission is to manage and operate a nationwide system for the joint collection and treatment of packaging and non-packaging product waste in contracted municipalities across the Slovak Republic. We offer producers a comprehensive compliance service that includes:
- Collection, transport, recovery, and recycling of packaging and non-packaging waste introduced to the market
- Waste management in accordance with Annex 3a of the Waste Act Registration of producers in the official packaging and non-packaging product registers maintained by the Ministry of Environment of the Slovak Republic
- Recordkeeping and reporting of aggregated producer data to the Ministry
- Fulfilling information obligations toward end-users of packaging and non-packaging products
- Reporting compliance with mandatory recovery and recycling targets

Pricing Offer
The fees for fulfilling extended producer obligations reflect the actual costs of collection, transport, preparation for reuse, recovery, recycling, treatment, and disposal of separately collected waste within the designated waste stream. These fees also cover the costs of informational and promotional activities, as well as all other extended obligations fulfilled by the PRO.
PRO Reclay Systems therefore reserves the right to adjust these fees reasonably, based on the quantity, composition, and recyclability of packaging and non-packaging products, as well as current market conditions. Any fee adjustments will be made in accordance with the principle of non-discrimination.
PRO Reclay Systems also reserves the right to adjust the fee per kilogram of waste in the designated waste stream. The basis for any such adjustment is a comparison of the current price list for non-packaging materials and packaging products, as stated in Annex 3, Sections A and B of the model agreement, with the actual costs of collection, transport, preparation for reuse, recovery, recycling, treatment, and disposal of separately collected waste and prevailing market conditions at the time the pricing offer is being prepared.
Before preparing a pricing offer, we will ask you to provide the necessary documentation — including, but not limited to: an overview of the quantities and types of packaging and non-packaging products placed on the market during the most recent reference year, including information on their material composition.
Signing of the Contract
Once the terms are approved, we’ll proceed to sign a contract for the fulfillment of your producer obligations.
This agreement ensures that we take full responsibility for meeting all legal requirements on your behalf — allowing you to focus entirely on your core business.
Registry Updates & Certification
Registration is a mandatory step to legally place your products on the market.
We handle the entire process for you:
- We prepare and submit your application
- We monitor its progress until official approval
- Once registered, we’ll provide your Producer Registration Number and a Certificate of Agreement with our PRO — an official document confirming your business is fully compliant with the Waste Act
Reporting Obligations & Client Portal
As a producer, you are required to submit quarterly or annual reports via our Client Portal.
To make this process as easy as possible:
- We’ve prepared a clear step-by-step guide for reporting the quantities of packaging and non-packaging products placed on the market
- You’ll receive this guide along with your login credentials to the Client Portal
- Through the portal, you can conveniently manage your obligations and submit your reports online
Is your business subject to producer obligations?
Are You a Producer?
Under § 52(11) of the Waste Act, you are considered a producer of packaging and are required to register if you meet any of the following conditions:
- You use or fill packaging to pack goods and place those goods on the market under your own brand,
- You import packaged goods across the state border and distribute them in Slovakia
- As a distributor, You provide packaging (free of charge or for a fee) directly to the final user for immediate product packaging, or you use packaging for goods you distribute
- You place packaging on the market, except for unused empty packaging supplied to other producers as described above
Beware of the “waste‑management paradox”!
In most cases, packaging producers are actually companies that do not manufacture packaging at all. At the same time, businesses that physically produce empty packaging are not considered packaging producers under the Waste Act.
Are You a Producer of Non-Packaging Products?
According to § 73(4) of the Waste Act, you are considered a producer of non-packaging products and must register if:
- You manufacture or commission the manufacture of a non-packaging product and place it on the market in the Slovak Republic
- You transport or import a non-packaging product from another country and place it on the market in the Slovak Republic
What Is a Non-Packaging Product?
A non-packaging product is defined as a product that:
- Is not packaging and is not intended for packaging purposes
- Produces waste that becomes part of municipal waste
- Can be made from materials such as glass, paper and cardboard, or plastic
Examples include: newspapers, advertising leaflets, business cards, toys, tiles, notebooks, diaries, plastic furniture, glass mirrors, and kitchen glassware
Obligations of packaging and non-packaging producers
- Register in the Register of producers of the reserved product and notify changes to the registered data,
- ensure the material composition of the product, its construction and its labelling in accordance with the Waste Act,
- fulfil the information obligation towards the public and the waste processor, ensure that the recovery and recycling targets for packaging waste are met,
- ensure the management of the waste stream to the extent and in the manner specified in the Waste Act,
- ensure the recovery and recycling of the packaging and non-packaging waste stream at least at the level of the mandatory recovery and recycling targets and limits for that waste stream,
- keep and maintain records and report data therefrom to the Ministry to the extent prescribed and retain the reported data,
- fulfil the information obligation in relation to the end users of the product
- calculate its collection rate and market share
- ensure that the entire quantity of separately collected municipal waste belonging to the waste stream is removed from the municipality in which it is responsible for the packaging and non-packaging waste stream and ensure the ongoing financing of the management of the waste stream so removed,
- appoint an authorised representative in the case of a foreign producer.
